It's funny, fustrating, and unfair that us DJ's who do our job by filtering music are getting copyright infridements on youtube. We listen and we try to get feedback from our listeners to see whats hot and whats not. Sure its a personal opinion, but the record industries spend much money trying to get input. As you may be well aware if you make a mix on youtube.. it can be muted or taken down. I know youtube is just trying to comply with copyright issues.. put out from ascap/bmi or any other major in the like. what do we do as dj's? should we leave it alone.. or should we fight for our right to spin records...?? what you think.. and lastly what can we do?

+1. I'd like an answer for this myself. I wonder why no one's answered it for a month?
On another note, I (and many other DJ's I personally know who suggested it to me) tend to do my live broadcast (admittedly of stuff not on Whitelabel.net such as Trance, Techno and Promo Only Mainstream Club) on USTREAM or over Shoutcast Radio Stations when asked to DJ for them.

I did and it's this particular point (Section 2.1) which I find somewhat gray:
Specifically, what constitutes Promotional Purposes? If, as a DJ, I test a new song on a crowd to gauge their reaction to it, I would consider it a promotional action and it would help me learn whether or not to ever play that song again.
Likewise; if, as a DJ, I record a short mix for YouTube, USTREAM, or other video services (even Facebook), does this constitute Promotional Playing or would this constitute a violation of the licensing agreement - especially since it potentially opens the song (which, would more likely than not be watermarked) to playback outside markets to which the song was not made available for over Whitelabel.net by the supplying label.
It's the latter which causes me to generally avoid using any Whitelabel.net material for online based broadcast / radio-shows.

I am not a lawyer or expert, but this might be the limiting section:
All other rights excluded: For the avoidance of doubt, any Download or any part of any Download may only be used by the User personally for Promotional Purposes, remains the property of the Record Label, and may not be sold, rented, reproduced (in any manner, including for backup purposes), broadcast, distributed, adapted, in any form.

Me neither, so take what I say with a grain of salt...
I have two points:
The first is that there's the letter of the law and the spirit of it. License holders often provide restrictions of usage but will be somewhat selective in their enforcement of those restrictions depending on the specific usage.
Secondly, generally speaking record labels are usually quite cool with DJ mixes finding their way out on to the interwebs. Stand alond tracks, however, are more frowned upon.
So broadly speaking I would say that using Whitelabel.net audio tracks in your online DJ mixes is not something that will attract unwelcome responses from record labels.

easy fix every time you upload a mix on youtube just include a "fair use" disclaimer and you should be golden, I know this because I myself has a youtube channel with regular viewers. here include this next time you put a vid up.

alright guys.. thanks for the input. I will try that out DJ EYCEE. I just wish that youtube can weed out a stand alone track verses a dj mix.. that would be awsome.
