I'm getting a used ibook & I need help.

My Brother in law might kick down his ibook but it has an older OS, 10.2 or something. I already have a PB with 10.4.6. Can I update/transfer the OS from my PB to the ibook, is this "legal"?

I don't think so, I think the license is for 1 computer so you would need to buy the 10.4 upgrade

For an iBook, I would look for a copy of Panther (10.3.9) and run that. It's more solid that 10.4.6 on the iBook (not the new ones of course).
