I was in a similar scam, I won my case though and got my money back
here is how i got scammed using paypal
1. sold a jailbroken for tmobile iPhone on ebay for $400, only 3 weeks old and in perfect condition
2. Buyer takes the buy it now and sends paypal money right away
3. Sent the iphone to user
4. when he recived it he bitched it was scratched and not as promised and disputed it with paypal who awarded him the complaint and said to send the iphone back for full refund
5. he sent back the iphone which I had to pick up from UPS, I signed for it and through it in my back seat and went to work, meanwhile he was given his money back right away and he pulled his money from Paypal into his account.
6. i open the box and find it's a broken $3 speaker thrown in there for weight purposes so now I am out the iphone and the money
I filed a police report and went through everything Paypal said to do and eventually Paypal gave me my money back, But it wasn't easy.
Be very careful!!!!

stay far away from paypal and ebay. I have known people use debit cards. And claim that their product wasn't what was described. Paypal sends their money back then they pull the money out of paypal and close the account. That's what made craiglist come alone. To secure your purchase in person. I don't use paypal after that happened to me and I never got shit back. All you have to do is complain and you get you're money back. 911 aint no joke paypal is a joke. Also watch out for the fake paypal email that comes from nigeria and other foreign countrys. Its easy to tell if you have a real email from paypal.

if you didn't say the box had scratches and the cd's were scratched. Then you lied right their. And that's why paypal won't return your call. If they looked at you're post and that wasn't their. They feel you were trying to get over. Good luck but its a waste of time.

From a buyers perspective, I love it. As a seller, it sucks. I just sold a used iPhone 3G on eBay. I sold it THREE times and each time the buyer did not pay on time or as agreed. I finally sold it the 4th time and it got there. I get an e-mail from the buyer saying the item was not as described and it was scratched. It had small surface scratches THAT I DESCRIBED IN THE AUCTION and included pictures. He also said that it was updated to too new of a version for him to jailbreak WHICH I ALSO DESCRIBED IN THE AUCTION.
Long story short, I had to refund the guy $100 of the $285 he paid for the phone just to finish the transaction. He wanted to return it all together and I was tired of f'ing with the whole thing.

no don't get me wrong but buying and selling from ebay has its perks. You have good and bad people. Also alot of scammers lurk on ebay. I have sold stuff and got fake paypal emails from places like nigeria and others. Becarefull and if you get a email from paypal about funds being held till you send a tracking number.its a scam email paypal and compare the emails. Also try and us craiglist to sell you're stuff in your state or city.

I bought a wiring loom for my project car, 300 Euro. Never came in the mail and by the time i reported it, it was too late, so ebay or paypal wouldn't do the dispute.
Found the guy in another forum selling stuff and confronted him but still nothing of it since i am in australia and he's in germany.
Lesson learned.

That sucks. Due diligence is key when doing online transactions. I ran into one problem with Paypal and tech support got at me real quick through email and a phone call all within a 24hr window. As for ebay, the most obvious is seller/buyer ratings and also where its coming from. Due diligence, 5-15 min. spent can prevent hours-days of headaches.

Paypal is a crock of bullshit. I receive some counterfeit item, complained to the seller that it was counterfeit and he emailed me back basically incriminating himself saying "it's just as good quality as the original". I had proof that he knew it was counterfeit.
Also I contacted other buyers who bought the same item and they all agreed it was counterfeit and they all filed a complaint with ebay and paypal.
I received a message the other day saying there wasn't sufficient proof so they couldn't refund my money. UMMM, wtf, the paypal emails between me and the seller clearly show the seller knew they were counterfeit.
PAYPAL IS NOT A SERVICE TO SECURE TRANSACTIONS! THEY ARE JUST A METHOD FOR YOU TO TRANSFER MONEY TO AND FROM ACCOUNTS, THATS IT.
If you want a secure transaction, buy and sell in person, and bring a gun just in case!

It's secure as your sensitive info is never shared with the seller which is one of the major reasons Paypal was created. I will never buy anything online without going with a pay service.

Apparently Paypal doesn't follow the same law you are studying.
Here are the facts kids...Ebay owns Paypal. Also Ebay requires you to accept Paypal on your auctions. You can state in your description that you don't accept it but the auction will still state you do.
To the original OP. Post the dudes location. See if anyone on the forum is near him. If so have them grab a few friends to go over and collect. Split the money with them and call it a day.

I almost got scammed by an ebay buyer named chlo718 (he resells Serato vinyl, so beware!)... they tried to pull that SNAD shit on me claiming that my brand new, never used, completely mint condition A-Trak vinyls were so worn and scratched that they were unusable. He was so full of shit - they had only been removed from the package once - to photograph them. He wanted a half-off discount. When I wouldn't do that (because I knew what he was attempting to do), he filed an SNAD claim. Via Paypal, he was told to send the vinyls back to receive payment. He supplied two fake tracking numbers to Paypal. Since he never sent anything back, Paypal ruled in favor of me (that's rare... the seller is almost always screwed in these cases). They also told me that he had file five of these SNAD claims with other sellers right after mine, so that worked in my favor. This was the last time I'll EVER do anything related to Ebay/Paypal. I couldn't even leave negative feedback as Ebay has removed that ability for sellers.
It used to be 'caveat emptor', but on Ebay it is now 'caveat venditor'.

eBay & paypal both blow. Not being able to leave negative feedback as a seller is the most ridiculous thing ever. Someone wastes your time & your money and you have no recourse. Bullsh*t!! The fees are getting out of hand. You can only charge $4 for shipping records. Again I say BULLSH*T!! On all my auctions I require insurance and delivery conformation. Between that, the packaging and the actual shipping charge from the post office I lose money on shipping every time I sell a record. It forces sellers to artificially increase the price of a record instead of letting the market dictate its value. This is why I only sell records on Gemm now.
As for being scammed, I had someone hack into my paypal account and withdraw a pretty big hunk of money from my bank account. It caused several checks to bounce. After much arguing with paypal about how I didn't authorize the transaction or know who the person was I finally got my money back. But while I was waiting for paypal to do something I switched bank accounts. I finally got my money back and paypal did cover the bounce check fees but only after they determined I wasn't trying to scam them. They then wanted me to go through the verification process all over again. I didn't do anything wrong but I have to prove my innocents again? Fu*k paypal and their parent company eBay.

Got a feeling I've been bumped over a keyboard I was selling. Well my dad sold. I haven't set up an ebay account yet.
Keyboard is in near perfect condition used once/twice max. Sold it via the buy it now otion. The guy received it said it was scratched and wanted a £40 refund. My dad said no and it wasn't scratched. Paypal have ruled in favour of the buyer and now he's got to return the keyboard and then he gets his money back.
Granted I could actually get my keyboard back but I've got that gut feeling that I won't. How can I resolve this issue if anything bad happens?

what is wack about all this is the time it takes, you can never get reimbursed for your time it takes with bureaucracy. Ususally when I list something on Ebay someone always messages me meet in person so Im happy with that. Craiglist is the move, meet in person especially for high tickets items is always a plus

What he did on my auction wasn't illegal or against the TOS, just sketchy. these guys are pretty good at skirting the law, or at least providing themselves enough plausible deniability that they avoid getting in trouble.
If he ripped any of you off I'd say go after him full scale via ebay, paypal, or threaten a lawsuit. Best defense is a good offense sometimes.

"Ok, well I did receive used serato records from that seller and the only reason the seller won is because I did not return the item. I decided to keep the vinyl even though they were used. Seller kept the money and I kept the records. I don't know why the seller would state that I have 5 other claims from sellers but its ok I understand your concern. Good luck on your auctions. If you have any colored Serat vinyl in the future please let me know. I could pay you directly to save fees from Ebay. Thanks"

Straight up BS. Paypal told me that he had five other SNAD claims at the same time. Would anyone in their right mind pay $260+ for 'unusable' (his word) control vinyl? Hell no! He even had the audacity, after trying to scam me, to send me an email asking if I could get more A-Trak vinyls for him! Karma, at some point, is going to bite this douchebag hard in the ass... and I'll have absolutely no sympathy for him.

I know back in 99-2007 or so I used to buy/sell stuff on ebay like mad. When they ditched the money order & check option and went paypal only I almost completely stopped going there. Ebay is collecting fees on auctions and getting rich off the paypal transactions as well. Total rip and only when I absolutely MUST get something off there (it's still the best place for me to get old U-Matic decks) do I go there.
